What time limit applies to lodge personal injury claim accident 01/10/2000 in Qld injured person DOB 12/01/88?

While riding dirt bike on private property my son hit a pile of rubbish, went airborne across road between this property and his place of residence and hit side of residence. He sustained multiple injuries - 10 days in Intensive Care and 5 weeks in Hospital. Date of accident was 01/10/2000. He was 12 at the time (dob 12/01/88). We were told at the time that he would not have a case for personal injury claim but current advice indicates he may. We have been given two conflicting opinions as to when a claim would need to be lodged. One opinion is 9 mths from when he turned 18. The other is 3 years from turning 18 ie 21 years of age.

  1. Depending on your state, you may have missed the statute of limitations for filing a suit. There are time limits on filing things like this. Check with your local magistrate court for statutes of limitations on personal injury claims. Most states have a limit of 2 years for personal injury claims to be filed.
  2. gee, I would file it now, what is the difference. I know in my accident in TX they said 3 years, just pasted and no claim was filed against me. Thank you lord. HOwever, I was not a minor at the time.
  3. The statute of limitations is about to run out if it hasn't already. it does not matter the age of the litigant. You must file the claim in a timely manner. You had better hurry!!!!!!!
  4. SOL depends on your state, and sometime the entity you may need to sue (for example, some city and county ordinances require notice within 6 months, Federal claims must be on file by 1 year); some SOL's are two years from the 18th birthday.

    It sounds like he was trespassing, was he? If he is found 51 percent negligent, he would not win in court. At 12, he should have known he should not have been on private property. It would be a tough case to litigate.
